Terms and Conditions

These Terms and Conditions apply to classes, private lessons, workshops, examinations, performances and other services provided by Stourbridge Dance Academy (“SDA”, “we”, “us” or “our”).

By registering a pupil, booking a class, paying an invoice or continuing to attend SDA, the pupil and their parent or guardian agree to these Terms and Conditions.

1. Enrolment

Parents and guardians must provide accurate and complete information when registering a pupil, including:

• The pupil’s full name and date of birth.

• Home address and contact details.

• Parent or guardian contact information.

• Emergency contact details.

• Relevant medical conditions, allergies, injuries or accessibility requirements.

Parents and guardians must tell SDA promptly if any of this information changes.

SDA may recommend a class based on the pupil’s age, experience and ability. Class placement remains at the academy’s discretion to ensure that training is safe and appropriate.

2. Fees and invoices

Class fees are invoiced half-termly in advance.

Invoices will normally be sent by email and must be paid in full within the first seven days of each half-term.

Payment should be made using the payment instructions shown on the invoice. Please use the pupil’s name as the payment reference where requested.

Additional charges for examinations, workshops, private lessons, performances, costumes, uniforms or events will be explained before the relevant booking is confirmed.

If an invoice remains unpaid, SDA may suspend the pupil’s place or refuse further attendance after giving reasonable notice. Outstanding fees will remain payable.

3. Missed lessons

Class fees reserve the pupil’s place for the relevant half-term.

All scheduled lessons remain payable if a pupil is absent because of illness, holidays, family commitments or any other personal reason.

SDA does not normally provide refunds, credits or replacement lessons for classes missed by a pupil.

Where possible and entirely at SDA’s discretion, an alternative class may occasionally be offered. This is not guaranteed.

4. Leaving the academy

If a pupil wishes to leave SDA, the parent or guardian should notify us in writing as soon as possible.

Fees already paid for the current half-term are non-refundable if a pupil leaves or stops attending during that period.

No further half-termly fees will be charged after the pupil’s current paid period has ended, provided all outstanding invoices and additional charges have been settled.

This clause does not affect any statutory rights that cannot legally be excluded.

5. Classes cancelled by SDA

SDA may occasionally need to:

• Change a teacher.

• Adjust a class time or location.

• Combine suitable classes.

• Provide a replacement teacher.

• Reschedule or cancel a lesson.

Where SDA cancels a paid lesson and cannot provide a suitable replacement, we will offer an appropriate rescheduled lesson, account credit or refund for the affected class.

SDA will not be responsible for unrelated travel, accommodation or other personal expenses resulting from a cancelled or changed class.

6. Events beyond our control

Classes may be affected by circumstances outside SDA’s reasonable control, including severe weather, building closures, public-health restrictions, transport disruption or emergencies.

Where reasonably possible, SDA may provide an alternative class, revised timetable, online session or account credit. Any remedy will depend on the circumstances and applicable consumer rights.

7. Attendance and punctuality

Pupils should arrive on time and be ready to begin their class at the scheduled time.

Parents and guardians remain responsible for pupils before they are handed over to the teacher and immediately after the class has finished.

SDA must be told in advance if someone different will be collecting a child.

Pupils should not attend when they are unwell, infectious or unable to participate safely. Parents should inform SDA about any injury or health issue that may affect participation.

8. Uniform and appearance

All enrolled pupils must wear the approved SDA uniform to lessons unless the teacher has agreed otherwise.

Hair must be tied back securely for every lesson.

Pupils must wear appropriate dance shoes and remove jewellery or other items where requested for safety.

Trial pupils should wear comfortable, suitable clothing until they have been advised about the correct uniform.

9. Behaviour

Pupils are expected to behave respectfully towards teachers, other pupils, staff and visitors.

Bullying, abusive language, deliberate disruption, unsafe conduct or damage to property will not be accepted.

SDA may ask a pupil to leave a class or may suspend or end their enrolment where behaviour presents a safety risk or continues after reasonable warnings.

Where enrolment is ended because of serious or repeated misconduct, fees already paid will not normally be refunded.

10. Health, injuries and emergencies

Dance and gymnastics involve physical activity and carry an inherent risk of injury.

Parents and guardians must provide any health information reasonably needed to allow the pupil to participate safely.

Teachers may adapt or stop a pupil’s participation where they believe continuing would be unsafe.

In an emergency, SDA may provide basic first aid, contact the pupil’s emergency contact or request emergency medical assistance.

Nothing in these terms excludes SDA’s liability for death or personal injury caused by its negligence, fraud or any other liability that cannot legally be excluded.

11. Examinations, performances and workshops

Participation in NATD examinations, performances, workshops and SD Squad activities may be subject to:

• Teacher approval.

• Attendance and preparation requirements.

• Additional rehearsals.

• Separate fees.

• Costume or uniform requirements.

• Rules imposed by the examination body, venue or event organiser.

Relevant costs and requirements will be explained before a pupil is committed to participating.

Fees paid to external examination bodies, venues or event organisers may be non-refundable once SDA has committed or transferred the payment.

12. Photography and video

SDA may photograph or film classes, rehearsals, examinations, performances and academy events.

Photographs or videos will only be used for advertising, social media, the SDA website or other promotional purposes where appropriate permission has been obtained.

Photography permission should be requested separately and must not be treated as a condition of attending ordinary classes.

Parents or guardians may withdraw promotional consent by contacting SDA. Withdrawal will apply to future use but may not be able to remove material that has already been printed or lawfully distributed.

Parents and visitors must not photograph or film other pupils without permission.

13. Personal information

SDA uses pupil and parent information to manage enrolment, fees, attendance, examinations, performances, safety and communication.

We do not sell personal information. Information may be shared where necessary with teachers, payment providers, examination bodies, event organisers, professional advisers or safeguarding and legal authorities.

14. Personal belongings and lost property

Pupils should avoid bringing valuable items to the academy.

SDA cannot accept responsibility for clothing, phones, jewellery, money or other personal belongings that are lost, damaged or left on the premises, except where the loss results directly from SDA’s negligence.

Any lost property found will be kept for a reasonable period before being donated or disposed of.

15. Products and uniforms

Products and uniforms purchased from SDA are subject to our Returns and Refund Policy.

Parents and pupils are responsible for checking sizes before purchasing or ordering an item.

16. Website information

We aim to keep class descriptions, timetables, prices and other website information accurate. However, details may occasionally change.

A class place is not guaranteed until it has been confirmed by SDA.

17. Changes to these terms

SDA may update these Terms and Conditions when its classes, prices, services or legal responsibilities change.

We will provide reasonable notice of any significant change affecting existing pupils. The latest version will be available on the SDA website.

19. Governing law

These Terms and Conditions are governed by the laws of England and Wales.

Nothing in these terms affects the statutory rights of a consumer.
